VIDEO CONTEST OFFICIAL CONTEST RULES
OVERVIEW & THEME
The purpose of the video contest is for participants to answer the following questions:
“How do you play in your neighborhood” and “Why does your neighborhood
rock?”
NO PURCHASE NECESSARY
No purchase is necessary or required to participate in the “My Neighborhood Rocks” video contest or to be a winner.
SPONSORS
The Sponsors of this contest are Chattanooga Neighborhood Enterprise, Inc. (“CNE”), 1301 Market Street, Suite 100, Chattanooga, Tennessee 37402, (423)756-6201 and Association for Visual Arts (“AVA”), 30 Frazier Avenue, Chattanooga, Tennessee, (423) 265-4282.
1. Eligibility
The contest is open to all residents that reside in a Chattanooga neighborhood whose neighborhood association is registered with the Chattanooga Neighborhood Services & Community Development Department. CNE reserves the right to validate the authenticity of the neighborhood association. Employees, officers, directors, agents, representatives of CNE and AVA or their immediate families or members of household (parents, children, siblings, spouse) are not eligible for the contest.
2. Prizes and Values.
Grand Prize: $5000.00
Runner Up Prizes: 1st runner up: $1000.00; 2nd runner up: $500.00.
Prizes will only be awarded to the eligible neighborhood association and are
not awarded to individual participants or group participants.
3. How to Enter.
Participants must enter online at www.cneinc.org or www.myneighborhoodrocks.com(collectively referred to as “the website”) and complete the online entry form. Eligible eighborhood associations are permitted to have more than one video submitted in the contest. Each submitted video must be accompanied with a new entry form. However, only one video entry per participant is permitted. If a participant enters more than one video, only the video first submitted with the completed entry form will be eligible to win. Any participant under the age of 18 must have his or her video entry submitted by his or her parent or guardian. Group Submissions: Groups of participants from their respective eligible neighborhood association may participate and submit one video on behalf of the entire group. Neighborhood Associations are permitted to have multiple groups submit videos. However, only one video entry per group is permitted. An entry shall be considered a group submission any time two or more participants are identified on the entry form. Participants must identify all individuals of the group and specify one member of the group that is the primary contact person for the group. A group entry must complete the required data requested on the entry form. It is not required that each individual identified in a group submission also complete an entry form separately or individually. If videos intended to be submitted as a group contain participants under the age of 18, the respective parent or guardian of the participant under the age of 18 must also be named as a participant of the group. All participants will be required to review and accept contest rules before they are permitted to submit a video for the contest.
4. Steps to Enter:
Eligible Participants must:
1. Read and agree to the contest rules described herein.
2. Submit a signed and completed entry form located on the website. All participants under the age of 18 must have their parent or guardian submit the Parental/Guardian Permission Form along with their entry form as indicated.
3. If the submission is on behalf of a group, the entry form must be completed identifying all participants and specify the primary contact person along with the Parental/Guardian Permission Form, if applicable, for each participant in the group under the age of 18.
4. Create a video clip that is Five (5) minutes long or less in duration. The video clip must identify the eligible neighborhood association. The Grand Prize will be awarded to the neighborhood association that best represents what the participants love about their respective neighborhood. Judging will be based on originality, creativity, adherence to the theme and overall quality.
5. Videos must be in .wmv, .avi, .mov, or .mpg file formats.
6. Submission of videos may only be accomplished by registering on the website and uploading the video in the form required herein. Videos may not be submitted in VHS or DVD formats. Each video must be approved by the contest administrator before it will be made available for public view. Videos will not be approved until all applicable forms and signatures are received by CNE. . Videos may be uploaded on the website between 12:01 a.m. EST on October 1, 2012 through 11:59 p.m. EST on October 19, 2012. The sponsor or its designated representative reserves the right to disqualify any submission that does not conform to these Official Rules or the Site Usage Agreement as determined by CNE in its sole discretion.
5. Contest Timeline:
Contest entries will be accepted beginning 12:01 a.m. EST on October 1, 2012 through 11:59 p.m. EST on October 19, 2012. On November 9, 2012, the top three (3) videos will be screened. A Grand Prize will be awarded to the eligible neighborhood association that best represents what they love about their neighborhood. Two (2) additional prizes will also be awarded. Prizes will only be awarded to eligible neighborhood associations
and will not be awarded to individual participants or group participants.
6. Submitted Videos:
The participant must not have granted any person or entity other than CNE the right to use the video. All submitted videos are required to conform to the following:
- must contain original work, created solely by the participant(s);
- must not have been previously published, released or distributed in any form;
- must not have won any previous award or have been submitted to any other contest;
- must not infringe the copyright, trademark, privacy, publicity, or other personal or proprietary rights of any person or entity;
- must not contain any music that requires permission, release, licenses, rights, clearance or other authorization from CNE;
- must not contain or reference any names, products, or services of any company or entity or any third-party trademarks, logos, trade dress or promotion of any brand, product or service; and
- must not contain any personally identifiable information of any person other than the participant(s).
Submitted videos will not be accepted or eligible if they include any content that contains or appears to contain:
- explicitly profane or obscene material
- endorsement (or condones) illegal drug use, alcohol abuse or other illegal activity;
- nudity, profanity, lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, or otherwise inappropriate content or objectionable materialor extreme or gratuitous violence; language, content and material will be evaluated by CNE based on context and societal acceptability;
- any express or implied commercial endorsement;
- any derogatory characterization of any person or group based on age, race, color, gender, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership or other unethical or unlawful factors;
- depictions of any conduct, language or other context deemed inappropriate by CNE or any of the judges;
- any real or perceived copying or infringement of another’s intellectual property rights.
By submitting their video entries, participants warrant that the submitted video and all elements contained therein does not infringe on any copyright owned by another. Participants also confirm that to the best of their knowledge, any statements made in the submitted video are true and do not violate or infringe on the rights of third parties. Each participant is solely responsible for obtaining from all applicable individuals or entities any and all required rights, releases, consents, clearances, licenses, and other authorization necessary to exploit and otherwise use their submitted video in any and all media. Clearances required include but are not limited to location releases and releases from any person whose name, voice, likeness or persona is referenced, shown, or
otherwise used in the submitted video. CNE reserves the right (but not the obligation) to verify that all necessary clearances have been obtained, prior to selecting the video as a finalist or winning video. CNE may disqualify any submitted video at any time if the participant has not obtained all necessary clearances. Participants must retain a copy of their submission in its original format after uploading it to the website. The winners selected will need to provide CNE with their submission in its original format. Failure to do so may result in disqualification and the selection of an alternate winner.
7. Judging
Videos will be judged by a committee of CNE and AVA representatives. Winning videos will be selected based on:
- Creativity (25%)
- Originality (25%)
- Adherence to the Theme (25%)
- Overall Quality (25%)
In the event of a tie, the entries involved will be re-judged by an additional judge who will serve as a tiebreaker and who will evaluate entries according to criteria listed above.
8. Conditions of Participation
Each participant agrees that CNE has an exclusive, unlimited, perpetual, and royalty-free license to use the submitted video in connection with promoting or marketing the contest or its theme, and future contests, materials or as CNE determines for attorneys or the general public. Each participant agrees that CNE may retain a copy of the submitted video and releases CNE from liability for any loss or damage thereto. Each participant,
by submitting the video to CNE, also consents, approves and authorizes CNE the right to use, broadcast, webcast, podcast, link to or from, syndicate, or otherwise exhibit or display the submitted video in its original or an altered form or format. Each participant rants CNE the unqualified, unrestricted, worldwide, irrevocable, perpetual and royaltyfree right to use his or her name, logo, marks, submission entries, and other distinctive
identification in connection with promoting or marketing the contest or its theme, and future contests, materials or as CNE determines for attorneys or the general public. The rights described in these official rules begin immediately upon submission of the video clip and continue indefinitely unless revoked in written notice from CNE to the participant. CNE has no obligation to post or display any submitted video and may at its discretion remove any submitted videos at any time. The participant releases CNE from any and all claims against the participant in connection with the submitted video. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest and never shall include
consequential or punitive damages, and in no event attorneys' fees. All federal, state and local taxes (if any) on prizes are the sole responsibility of the winners. All federal, state and local laws and regulations apply. By sending in an entry to the contest, a participant agrees to abide by and be bound by these rules. CNE shall not be responsible for technical, pictorial, typographical or editorial errors in these rules or other materials relating to the contest. CNE is not responsible for any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions; interruptions; deletions; or defects of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant's
or any other person's computer relating to or resulting from participation in this contest; inability to access the website; theft; tampering, destruction or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or misdirected, inaccurate, undelivered, delayed, stolen, mutilated, incomplete, illegible or any combination thereof; or for any
other errors, problems or malfunctions of any kind relating to or in connection with this contest, whether computer, network, technical printing, typographical, human or otherwise, including without limitation, errors, problems or malfunctions that may occur in connection with the administration of the contest, the processing of entries, the announcement of the prizes or any contest-related materials. Proof of online submission is not considered proof of delivery or receipt. Participants agree that their name may be posted on the website or revealed. Entry materials that have been tampered with or altered are void. If, in CNE’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the contest, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the contest, CNE reserves the right at its sole discretion to disqualify any individual or group who tampers with the entry process and void any entries submitted fraudulently, to modify or suspend the contest, or to terminate the contest. Should the contest be terminated prior to the stated last date of the contest, notice will be posted on the website. Any attempt by a participant or any other individual to deliberately damage any website or undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made, CNE reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. General Conditions Participant agrees that any disputes arising under the contest shall be governed by
Tennessee law, and must be brought in the state or federal court located in Hamilton County, Tennessee. Except as provided for herein, prizes are non-transferable and no substitutions or exchanges are permitted. CNE is not responsible for illegible, lost, late, misdirected, damaged or incomplete entries. All materials submitted become the property of CNE.
